Draft of Industrial Relation (Uttarakhand) Rules, 2021

The Draft Rules of Uttarakhand for the Industrial Relations Code (“Draft Rules”) has been notified in the gazette 25 February 2021.

Applicability

The Draft Rules upon coming into force shall extend to the whole of Uttarakhand state in respect of the industrial and commercial establishments for which the state Government is the appropriate Government and shall come into force on the date of their publication in the Official Gazette.

The Rules upon coming into force will repeal:

  • The Uttar Pradesh Trade Union Regulations, 1927;
  • The Uttar Pradesh Industrial Employment (Standing Orders) Rules, 1946;
  • The Industrial Disputes (Uttar Pradesh) Rules, 1958; and
  • The Industrial Tribunal and Labour Courts Rules of Procedure, 1967

Compliances

  • Form A – Memorandum of settlement arrived at during conciliation/ or settlement arrived at between the employer and his workers otherwise than in the course of conciliation proceeding [Rule 2]
  • Form B – Application for Registration of Trade Union [Rule 10(1)(a)]
  • Form C – Register of Trade Unions [Rule 11(1)]
  • Form D – Certificate of Registration of Trade Unions [Rule 11(2)]
  • Form E – Application for withdrawal or cancellation of Certificate of Registration [Rule 27(1)]
  • Form F – Annual Return for the Year Ending [Rule 28(1)]
  • Form G - Form of Register of Certification of Standing Orders [Rule 37(1)]
  • Form H - Application for modification of existing standing order [Rule 38]
  • Form I - Notice of change of service conditions proposed by an employer [Rule 39]
  • Form J - Notice of change of service conditions proposed by an employer [Rule 40, 42(3)]
  • Form K - Authorization by a worker, group of workers, employer, group of employers to be represented in a proceeding before the authority [Rule 42, 61]
  • Form L - Form of Oath of Office for judicial Member or Administrative Member (whichever is applicable) of State Industrial Tribunal [Rule 43(21) & 44(21))
  • Form M – Application to be submitted before the Tribunal in the matter not settled By the Conciliation Officer [Rule 45(5)]
  • Form N - Summons [Rule 45(10)]
  • Form O - Registration of settlement [Rule 45(35)]
  • Form P - Certificate of registration [Rule 45(35)]
  • Form Q - Notice of Strike to be given by Union (name of Union)/Group of Workers) [Rule 46]
  • Form R - Notice of Lock-out to be given by an employer of an industrial establishment [Rule 47]
  • Form S – Notice of Intimation of Retrenchment/ Closure to be given by an employer to the State Government under the provision of Chapter IX of the Code and rules made thereunder [Rule 48, 50]
  • Form T – Application for permission of lay-off/ continuation of lay-off/Retrenchment/ Closure to be given by an employer / Industrial establishment /Undertaking to the State Government under the provisions of chapter X of the Code and rules made thereunder [Rule 51,53 & 55]
  • Form U – Notice to the Employer who committed an offence for the first time under this code, for compounding of offence under section 89(4) [Rule 58(1)]
  • Form V – Complaint under Section 91 of the Code [Rule 60(i)]
