Draft of Industrial Relation (Haryana) Rules, 2021

The Draft Rules of Haryana for the Industrial Relations Code (“Draft Rules”) has been notified in the gazette on 16 September 2021.

Applicability

The Draft Rules upon coming into force shall extend to the whole of the State of Haryana in respect of the industrial establishments or undertakings and matters for which the State Government is the appropriate Government, and they shall come into force from the date of their final publication in the Official Gazette after the date of the commencement of the Industrial Relations Code, 2020.

  • Form I - Memorandum of settlement arrived at during conciliation/ or settlement arrived at between the employer and his workers otherwise than in the course of conciliation proceeding [Rule 3]
  • Form II – Application for Registration of Trade Unions [Rule 8)]
  • Form III - Certificate of Registration of Trade Union [Rule 10]
  • Form IV - Register of Trade Unions [Rule 11]
  • Form V - Annual Return p [Rule 33]
  • Form VI - Application to be submitted for adjudication before the Tribunal under section 22(1) of Code regarding dispute [Rule 31]
  • Form VII - Register for certified standing orders [Rule 42]
  • Form VIII - Notice of change of service conditions proposed by an employer [Rule 44]
  • Form IX - Agreement for voluntary arbitration [Rule 45]
  • Form X - Authorization by a worker, group of workers, employer, group of employers to be represented in a proceeding before the authority under this Code [Rule 47, 69 & 70]
  • Form XI - Form of Oath of Office for Administrative Member of Industrial Tribunal [Rule 49]
  • Form XII - Application to be submitted before the Tribunal in the matter not settled by the Conciliation Officer [Rule 52]
  • Form XIII - Application under sub-section (1) of section 59 of the Code [Rule 53]
  • Form XIV - Application by a person authorised by a worker or by the assignee or heir of a deceased worker under section 59(1) of the Code [Rule 53]
  • Form XV - Application under section 59(2) of the Code (35 of 2020) [Rule 53]
  • Form XVI - Application by a person who is an assignee or heir of a deceased worker under section 59(2) of the Code [Rule 54]
  • Form XVII - Notice of Strike to be given by Union (Name of Union)/ Group of Workers [Rule 54]
  • Form XVIII - Notice of Lock-out to be given by an employer of an industrial establishment [Rule 55]
  • Form XIX - Notice of Intimation of Retrenchment/ Closure to be given by an employer to the State Government under the provisions of Chapter IX of the Code and rules made thereunder [Rule 56 & 58]
  • Form XX - Application for permission of Lay-off/ Continuation of Lay-off/ Retrenchment/ Closure to be given by an employer / Industrial establishment /Undertaking to the State Government under the provisions of Chapter X of the Code and rules made there under [Rule 59, 61 & 63]
  • Form XXI - Notice to the Employer who committed an offence for the first time under this code, for compounding of offence under section 89(4) [Rule 66]
  • Form XXII - Complaint under Section 91 of the Code before the Conciliation Officer/Arbitrator/Industrial Tribunal [Rule 68]
